What Information Is Mandatory on Packaging? A Regulatory Guide

Learn which legal elements, icons, and font sizes are mandatory on packaging in Romania and the EU to avoid fines and product recalls.

What Information Is Mandatory on Packaging? A Regulatory Guide

Packaging design is not just about choosing attractive colors and modern typography. Without complying with national and European regulations, a visually excellent package can be blocked at customs or recalled from store shelves by consumer protection authorities. As a graphic designer, I frequently collaborate with manufacturers and importers to combine aesthetics with strict legal requirements.

What elements are mandatory on all packaging in the EU?

Any packaging sold within the European Union must contain clear identification data for both the product and the economic operator.

This general requirement includes the following basic information:

  • The exact product name (which must not mislead the buyer);
  • The name and address of the manufacturer or EU importer;
  • The net quantity (expressed in grams, milliliters, liters, or units);
  • The production lot number and minimum durability date (or expiration date);
  • The list of ingredients or components (where applicable);
  • The country of origin or place of provenance.

Missing any of these elements results in direct fines from authorities, often starting at several thousand lei and potentially leading to a temporary sales suspension. When working on a design grafic packaging project, I create a dedicated technical grid to ensure all legal mentions are clearly visible from the concept phase.

What special rules apply to food product packaging?

Food packaging is strictly regulated by EU Regulation No. 1169/2011, which enforces precise rules for legibility and nutritional tables.

On food packaging, you must obligatorily integrate:

  • A nutritional declaration per 100g or 100ml (energy value, fats, carbohydrates, proteins, salt);
  • Highlighted allergens in the ingredients list (using bold text, underlining, or a contrasting color);
  • Special storage conditions and instructions for use/preparation;
  • Energy value expressed clearly in both kJ and kcal.

Additionally, if the product contains sweeteners or caffeine over 150 mg/l, specific warning statements are required near the product name. Integrating these complex data points without cluttering a clean identitate vizuală is one of the biggest challenges in packaging design.

What is the minimum font size for legal text on packaging?

The mandatory minimum font size for required legal information is 1.2 mm, calculated based on the height of the lowercase "x".

For small packages with a maximum surface area under 80 cm², the minimum height for the lowercase "x" drops to 0.9 mm. If the total printable area is under 10 cm², the nutritional table is no longer mandatory, but the product name, allergens, and net quantity remain strict requirements. During the layout process, I always verify these measurements at a 1:1 scale before sending files to print. Ignoring these dimensions leads to automatic rejection by major retail chains.

How should the EAN-13 barcode be positioned and structured?

The EAN-13 barcode must be placed on a flat surface, preferably in the lower right corner of the back panel, with high contrast between bars and background.

The standard (100%) size of an EAN-13 barcode is 37.29 mm wide by 25.93 mm high, but it can be scaled between 80% (29.83 x 20.74 mm) and 200%. The bars must always be dark (ideally black, dark blue, or dark green) on a white or very light background. Red must never be used for bars because laser scanners use red light and will fail to read it. The quiet zone (white margins on left and right) must remain completely free of graphics.

What recycling and environmental symbols are mandatory in Romania?

In Romania, waste management symbols, the CE compliance mark (where applicable), and the official Deposit-Return System (SGR) logo are required.

The main mandatory or recommended marks include:

  • Official SGR logo with a specific barcode for single-use drink containers made of glass, plastic, or metal (0.1l - 3l);
  • The Mobius Loop symbol (three chasing arrows) indicating material recyclability;
  • Material identification codes (e.g., PAP 20 for corrugated cardboard, PET 01, HDPE 02);
  • The Tidyman symbol (person disposing of trash in a bin).

Missing the official SGR logo prevents beverages from being sold on the Romanian market. In my portofoliu projects, I allocate dedicated technical space for these icons right from the initial draft.

What rules apply if I import products from outside the EU?

Products imported from non-EU countries must have all mandatory information fully translated into Romanian, either printed directly or added via supplementary labeling.

The translation label must be firmly attached and must not cover original details like batch numbers or expiry dates. The EU importer's name and address must be clearly visible. If the original packaging features a recognized logo or established graphics, the sticker label should be placed on a secondary area. Automated translations performed without legal terminology checks can attract severe penalties.

How can I integrate legal elements without ruining the packaging design?

Integrating mandatory content without compromising visual appeal is achieved through clear typographic hierarchy and organizing data on secondary panels.

The Principal Display Panel (PDP) should be kept clean, reserved for the product name, brand, net weight, and primary marketing claims. All legal texts, ingredient lists, and nutritional tables are placed on the back or side panels. I use separate color blocks or neutral technical containers to distinguish legal copy from commercial visuals. A well-designed site de prezentare can host extended details, but the physical package remains the primary legal medium.

Who holds legal liability if packaging contains errors in mandatory information?

Legal and financial responsibility for the accuracy of mandatory packaging details rests solely with the business operator putting the product on the market.

The graphic designer is responsible for technical execution, legibility, and print file setup, but does not have the legal authority to verify ingredient compliance or regulatory classifications. For this reason, I advise clients to obtain approval from a compliance specialist or legal counsel before approving print proofs. A single typo in an allergen list can trigger a complete product recall, resulting in substantial financial losses.

What is the "e" mark next to the net quantity and when is it used?

The small "e" mark (E-mark) guarantees that the product was packed according to European metrological rules for net quantity control.

This symbol certifies that the product volume or weight stays within legally allowable error margins during automated filling. The "e" mark must have a minimum height of 3 mm and must be placed in the same visual field as the net quantity numeral (e.g., 500g ℮). Using it builds trust with European retail networks and demonstrates a rigorous quality control process.
